Terminal and Port Plan Submissions

Terminal Plans are a planning document that was required to be submitted to CARB by regulated marine terminal operators (or port staff, on behalf of terminal operators) discussing how a regulated terminal intends to comply with the requirements of the At Berth Regulation. The requirements for a terminal plan are found in Section 93130.14(a) of the Regulation. More information about Terminal Plans can be found here.
Terminal Plans were due to CARB by December 1, 2021. Once received, CARB staff had 90 days to review Plan submittals and identify any deficiencies in the Plan(s). CARB provided written responses to every submitted Terminal Plan confirming either Plan completeness or identifying deficiencies to applicable terminals. The below table includes the original and revised (as applicable) Terminal Plans, as well as the written communication from CARB to the Terminal Plan submitter. Additional revised Terminal Plans for ro-ro and LA/LB tanker terminals were due to CARB by February 1, 2024. These plans are under review by CARB staff, following the same process as outlined above, and will be posted here as their review is completed by staff.
Terminals and ports that were considered “low activity” are also required to submit a plan once the annual visit threshold is exceeded. A low activity terminal that exceeds the annual visit threshold (i.e., receives 20 or more visits per year for two consecutive calendar years from a vessel type) is required to reduce emissions starting January 1 of the following year and shall submit a terminal plan by July 1 of the following year (section 93130.14(a)(2)(E). In addition, ports shall submit an updated plan by July 1 of the following year after any new terminal at the port exceeds the annual visit threshold (section 93130.14(b)(2)(E).
