Governor's Veto Message

To the Members of the California State Senate:

I am returning Senate Bill 972 without my signature.

This bill requires the Department of Resources Recycling and Recovery (CalRecycle) to develop procedures for local jurisdictions to request technical assistance regarding the disposal of organic material in landfills. It also requires CalRecycle to consider providing technical assistance before exercising its enforcement authority, if a local jurisdiction has submitted a technical assistance request.

While I appreciate the author's intent to assist local jurisdictions in meeting California's organic waste reduction and diversion targets established in Senate Bill 1383 (Lara, 2016), this bill is unnecessary and duplicative of existing efforts. CalRecycle currently offers a suite of technical assistance materials and comprehensive staff assistance for all jurisdictions in the state specific to Senate Bill 1383. Further, the Local Assistance and Market Development branch within CalRecycle regularly meets with local jurisdictions, including monthly Senate Bill 1383 roundtables, and conducts annual site visits to provide customized assistance consistent with each jurisdiction's needs.

For this reason, I cannot sign this bill.

Summary

Enacts the Safe Drinking Water, Wildfire Prevention, Drought Preparedness, and Clean Air Bond Act of 2024, which would authorize the issuance of bonds in the amount of $10,000,000,000 if approved by voters, for safe drinking water, drought, flood, and water resilience; wildfire and forest resilience, coastal resilience, extreme heat mitigation, biodiversity and nature-based climate solutions; climate-smart, sustainable, and resilient farms, ranches, and working lands; park creation and outdoor access; and clean air programs.

Summary

Would have established the Equitable Access to Zero-Emission Vehicles Fund and would make moneys in the fund available, upon appropriation by the Legislature, to establish a program no later than January 1, 2025, to offer rebates for the purchase of zero-emission vehicles to underserved individuals, as specified. This bill would have also required CARB to submit a report to the Legislature every two years, starting on or before December 31, 2026, that describes the rebates, recommendations to improve the equitable distribution of the Fund, and any recommendations to better complement the Clean Cars 4 All Program. Was not heard in the Assembly Transportation.

Summary

Would have prohibited CARB from enforcing the requirements of the Ocean-Going Vessels at Berth regulation for tanker vessels carrying petroleum crude or petroleum products by two years. Tanker vessels visiting the Port of Los Angeles or Long Beach would have needed to comply with the regulation beginning January 1, 2027, instead of January 1, 2025, and tanker vessels visiting any other port in the State would have been required to comply with the regulation beginning January 1, 2029, instead of January 1, 2027. Summary 

Would have required CARB to provide exemptions to "local ferries" from any air pollution standard or regulation that requires the retirement, replacement, or retrofit of the vessel. This bill would provide this exemption for vessels for up to 15 years, or until the cost to replace the marine vessel's internal combustion engine with a new electric motor does not exceed the cost by more than 20%. The proposed definition of local ferry was specific to the Balboa Island Ferry, which is a small vessel that makes extremely short trips. Failed passage in the Assembly Transportation Committee and was granted reconsideration.

Would have established a freight coordinator, as appointed by the Governor, to serve as the advisory and coordinating entity for the Governor’s Office of Business and Economic Development. The freight coordinator would have: 1) advised and coordinated policies that promote the growth, competitiveness, and sustainability for freight and the supply chain across the State, 2) promoted and assessed the continued economic vitality and sustainability of the freight sector, 3) advised the Governor and director on issues affecting the State’s freight and supply chain, including economic strategy, investment, improvements in technology, policy, and regulations, and 4) worked directly with specified State agencies including CARB, to address and discuss ongoing freight and supply chain issues.
