2024 – Assembly Bill 1992 (Boerner, Tasha), Carbon sequestration: Blue Carbon and Teal Carbon Demonstration Projects (Vetoed)

Summary 

Would have allowed the California Natural Resources Agency to authorize teal carbon demonstration projects and develop, with consultation from CARB and other parties, a teal carbon demonstration project program starting January 1, 2028. The bill would have also allowed the California Coastal Commission (Commission) to authorize blue carbon demonstration projects and develop, with CARB and other parties, a blue carbon demonstration project program. The bill would have allowed the Commission to require an applicant with a nonresidential project that impacts coastal wetland, subtidal, intertidal, or marine habitats or ecosystems to build or contribute to a blue carbon demonstration project. The bill would have required these provisions (both teal and blue carbon demonstration projects programs) to be implemented only upon an appropriation by the Legislature for its purposes.

Governor’s Veto Message

To the Members of the California State Assembly:

I am returning Assembly Bill 1992 without my signature.

This bill would authorize the California Coastal Commission and the California Natural Resources Agency to facilitate the development of blue and teal carbon demonstration projects in certain coastal areas and inland wetlands.

California is a global leader in advancing nature-based carbon capture and sequestration solutions, having built and expanded our portfolio of actions over decades. In fact, between 2020 and 2023 alone, the State invested approximately $9.6 billion in nature-based solutions. Additionally, I signed Assembly Bill 1757 (C. Garcia) in 2022, which required the State to develop achievable carbon removal targets for natural and working lands. This same year, the Natural and Working Land Climate Smart Strategy cataloged over 350 efforts across State agencies to deliver meaningful nature-based solution climate action.

While I share the author's desire to accelerate novel nature-based climate solutions, this bill creates a new, unfunded program. In partnership with the Legislature this year, my Administration has enacted a balanced budget that avoids deep program cuts to vital services and protected investments in education, health care, climate, public safety, housing, and social service programs that millions of Californians rely on. It is important to remain disciplined when considering bills with significant fiscal implications that are not included in the budget, such as this measure.

For these reasons, I cannot sign this bill.

Was not heard in the Senate Natural Resources and Water Committee.

2020 - Assembly Bill 3005 (Rivas, Robert), Leroy Anderson Dam and Reservoir: Permitting, Environmental Review, and Public Contracting (Vetoed)

Summary

Would have expedited permitting and contracting requirements and California Environmental Quality Act procedures to facilitate the replacement of the Leroy Anderson Dam and Reservoir, required CARB to complete a greenhouse gas emission determination on specified project components, established requirements for greenhouse gas emission reduction mitigation measures, and authorized CARB to charge a fee for its work.  The greenhouse gas determination framework would have been similar to the Jobs and Economic Improvement through Environmental Leadership Act of 2011 (AB 900, Buchanan, Chapter 345, Statutes of 2011).

Governor’s Veto Message:

To the Members of the California State Assembly:

I am returning Assembly Bill 3005 without my signature.

This bill would modify contracting requirements and prescribe expedited California Environmental Quality Act (CEQA) review and regulatory processes for various state agencies to facilitate projects for the Leroy Anderson Dam and Reservoir.

Notwithstanding the importance of completing projects at the Anderson Dam, the bill sets unrealistic timelines for state entities to expedite deliverables.  This will require staff to be diverted away from other critical projects throughout the state that are going through the CEQA process.  Although the Anderson Dam projects are a key element of dam safety, it is problematic to set a precedent for a special process and timeline for one project that may undermine the quality of review by departments.

Furthermore, a public works project of this magnitude will have significant environmental impacts, and therefore, review through the full CEQA process is necessary.

For these reasons, I am returning Assembly Bill 3005 without my signature.

2020 - Assembly Bill 841 (Ting, Philip), Electric Vehicle Infrastructure Training Program and Energy Efficiency Programs (Chaptered)

Summary

Requires the California Public Utilities Commission, on or before March 1, 2021, to review and decide whether to approve two specific pending transportation electrification infrastructure applications and to issue a decision reauthorizing and extending programs and investments previously approved.  This bill also creates the School Building Energy Efficiency Stimulus Program that consists of:  (1) the School Reopening Ventilation and Energy Efficiency Verification and Repair Program and (2) the School Building Noncompliant Plumbing Fixture Program to be adopted by the investor-owned utilities and administered by the California Energy Commission.  The bill requires that up to 25 percent of installation crew members of any State‑funded electric vehicle charging infrastructure be certified under the Electric Vehicle Infrastructure Training Program.
