2023 – Assembly Bill 1594 (Garcia, Eduardo), Medium- and heavy-duty zero-emission vehicles: public agency utilities (Chaptered)

Summary 

This bill requires CARB to authorize public agency utilities to purchase replacements for traditional utility-specialized vehicles that are at the end of life, as determined by CARB in consultation with public agency utilities, when needed to maintain reliable service and respond to major foreseeable events, including, but not limited to, severe weather, wildfires, natural disasters, and physical attacks, without regard to the model year of the vehicle being replaced. The bill also states that in determining the daily usage of a medium- or heavy-duty vehicle, a public agency utility may provide comprehensive usage data for a class of vehicles that does not exclusively rely on the lowest mileage reading and does not exclude the highest usage days.

Summary 

This bill requires, commencing January 1, 2035, 100% of all newly purchased or contracted schoolbuses of a school district, county office of education, or charter school to be zero-emission vehicles, where feasible. The bill authorizes local educational agencies, in order to comply with the aforementioned  requirement, to request a one-time extension for a term not to exceed 5 years if a local educational agency determines that the purchase or contracting of a zero-emission schoolbus is not feasible due to both terrain and route constraints, provided that certain conditions are met.

CARB defers to the California Energy Commission’s (CEC) analysis on the impacts of this bill on the CTP program and defers to the Bureau of Automotive Repairs (BAR) for the impact to the CAP program. Authorizes the CEC to set a maximum gross gasoline refining margin, petition a court to enjoin a refiner from exceeding the gross margin, and impose a civil penalty on a refiner for exceeding the gross margin. The bill requires CEC and CARB, by December 31, 2024, to prepare a Transportation Fuel Plan. The plan will be required to include how to ensure that the supply of petroleum and alternative transportation fuels is affordable, reliable, equitable, and adequate to meet the demand for those transportation fuels described in the most current scoping plan approved by the CARB.

Summary 

This bill requires corporations with total annual revenues over $500 million and operating in California, beginning December 31, 2024, and annually thereafter, to develop a report on its climate-related financial risks and submit them to a climate reporting organization contracted by CARB, unless it already develops a similar report, as specified. The bill requires the climate reporting organization to prepare a public report that reviews the disclosure reports, an analysis of systemic and sector-wide climate-related financial risks, and identification of inadequate reports. The bill requires CARB to set a fee to cover its costs and adopt regulations authorizing it to seek administrative penalties for entities that fail to report, not exceeding $500,000 in a reporting year.
