Summary 

Updates AB 1757 (C. Garcia, Chapter 341, Statutes of 2022) by removing language that made natural and working lands emissions reduction projects and actions that receive state funding ineligible to generate credits under a market-based compliance mechanism and instead requires CARB to ensure that all greenhouse gas emissions reductions and removals used for any market-based compliance mechanism are in addition to any reductions and removals that would otherwise occur.

Summary 

Prohibits a local agency from approving the development or expansion of any qualifying logistics use, as defined, within 1,000 feet of sensitive receptors, as defined, except as provided. Authorizes a local agency to approve the development or expansion of a qualifying logistics under certain conditions, including, among other things, conducting a cumulative analysis of the air quality impacts of the warehouse development project, as specified. The bill also requires a local agency, upon receipt of an application for a warehouse development project, to take certain actions. Summary 

Authorizes the legislative bodies of local governments to jointly form a Reinvestment in Infrastructure for a Sustainable and Equitable California district (RISE district) in accordance with specified procedures. The bill requires the California Office of Planning and Research to develop standards for the formation of RISE districts no later than November 30, 2025, and provides for the establishment of a governing board of a RISE district with representatives of each participating local government, raising revenue to support RISE, and a revolving loan fund. Summary 

Would have required the air districts, in adopting a Community Emission Reduction Program, to consult with other relevant State agencies and would have required those agencies to implement and enforce measures assigned to them by CARB and the districts, as a part of the Community Emission Reduction Program, unless the agency found those measures infeasible at a public meeting of its governing body. The bill would have specified that Community Air Grants include, to the extent the Legislature appropriated funds specifically for this purpose, the option to provide the AB 617 community steering committees an allocation of funds to serve as a budget for administrative items, including, but not limited to, translation services, meeting venues, meeting coordination, training, and stipends, as authorized by the air district, for members of the committee. Summary 

Requires any commercial feed, feed additive, or drug approved by the United States Food and Drug Administration that is fed to livestock to be under the oversight of the California Department of Agriculture as the primary State regulatory agency, including, but not limited to, products that make environmental and health claims. This provision explicitly does not limit the CARB’s authority in Section 39730.7 of the Health and Safety Code.

Summary 

Requires the California Transportation Commission (CTC) to convene relevant State agencies to assess the procurement and implementation of data, modeling, and analytic software tools to support various State goals, and requires the CTC to develop, by July 1, 2025, a proposal to procure and a process to provide access to data, modeling, and analytic software tools, among other provisions. As a condition of receiving a grant of funds or access to data, modeling, and analytic software tools provided by the commission, a State or local agency shall submit a report by August 1, 2027, to the CTC about the use of the data, modeling, and analytic software tools for sustainable transportation, safety, active transportation planning, equity, affordable housing, efficient land use, air quality, or climate change-related program.

Summary 

Would have required CalRecycle to allow a local jurisdiction until December 1, 2031, in procuring recovered organic waste products to meet the target procurement requirements under the Short-lived Climate Pollutant Strategy, to use California-derived recovered organic waste that the local jurisdiction sends for processing at a facility outside of the State that meets certain conditions, as provided. Summary 

Would have required CARB by December 31, 2025, to include in the SB 901 (Dodd, 2018) report, a methodology to quantify GHG and short-lived climate pollutant emissions, including black carbon from wildfire, pile burning, and forest management activities and a list of the data needed to use the methodology. This bill also would have established a Forest Waste Biomass Utilization Program to be administered by the State Board of Forestry and Fire Protection’s Joint Institute for Wood Products Innovation, required the California Natural Resources Agency to facilitate the inclusion of recommendations for forest biomass waste utilization in relevant State climate adaptation plans, and required the California Energy Commission to report on innovative bioenergy technologies that utilize forest biomass waste. This bill was similar to AB 2878 (Aguiar-Curry, 2022).  Held on suspense in the Assembly Appropriations Committee.

Summary 

Would have suspended the California High-Speed Rail Authority appropriation for 2024–25 and 2025–26 fiscal years and transferred the money to the General Fund, to be available upon appropriation to augment funding for water conveyance, water storage infrastructure, and flood prevention and required a $2.4 billion loan from pre-2023–2024 FY Greenhouse Gas Reduction Fund monies to the General Fund for the same purpose, among other things. Was not heard in the Assembly Committee on Transportation.
