2023 – Senate Bill 422 (Portantino, Anthony), California Environmental Quality Act: expedited environmental review: climate change regulations (2-Year)

Summary 

For CARB and air districts, this bill expands the California Environmental Quality Act (CEQA) regulatory process to apply to virtually every regulation CARB and districts might promulgate, regardless of environmental impact. Requires CARB, air districts, and other specified agencies to complete a specific alternative environmental analysis or the equivalent of an Environmental Impact Report for every regulation adopted that directly or indirectly requires emission reductions of greenhouse gases, criteria air pollutants, or toxic air contaminants. This bill might expand the circumstances under which a focused Environmental Impact Report could be used by regulated entities for the installation of air pollution control equipment and related components and also could add extensive labor requirements if the focused Environmental Impact Report is used, both under current law and under the expanded CEQA analysis on regulations required by this bill. Summary 

Enacts the Safe Drinking Water, Wildfire Prevention, Drought Preparation, Flood Protection, Extreme Heat Mitigation, and Workforce Development Bond Act of 2024, which, if approved by voters, would authorize the issuance of bonds in the amount of $15.995 billion to finance projects for safe drinking water, wildfire prevention, drought preparation, flood protection, extreme heat mitigation, clean energy, and workforce development programs. As related to CARB, the bond allocates $125 million to the State Board of Forestry and Fire Protection, who would consult with CARB and California Natural Resources Agency to fund projects that provide long-term capital infrastructure to convert forest and other vegetative waste removed for wildfire mitigation to uses that maximize reductions in the greenhouse gas emissions, provide local air quality benefits, and increase local community resilience against climate change impacts. This bill also allocates $500 million to the California Energy Commission, in coordination with CARB and the Governor’s Office of Business and Economic Development, for grants to assist in obtaining, or as a match fund for, federal grants related to regional hubs in the federal Infrastructure Investment and Jobs Act and the federal Inflation Reduction Act of 2022. Commencing January 1, 2024, requires each transportation planning agency, when updating the regional transportation plan, to base the sustainable communities strategy (SCS) on population projections produced by the California Department of Finance and regional population forecasts used in determining applicable city and county regional housing needs, in consultation with each council of governments, and describe how to resolve differences in population projections. This bill also requires the annual Regional Housing Needs Assessment report that a city or county planning agency provides annually to the California Department of Housing and Community Development to include the progress of the city or county towards the recommended alignment of land use regulations with applicable SCS or alternative planning strategy.
