Summary

Would have defined mobile fueling on-demand tank vehicles that provide gasoline to passenger vehicles as mobile sources, to be regulated by CARB. Traditional stationary gas stations are currently regulated by local air districts with a major focus on toxic air contaminants that can cause cancer to nearby sensitive receptors. Air district permitting considers equipment standards, throughput limits, identification of nearby vulnerable populations such as children and the elderly, and involves working with local land use authorities to reduce public health impacts. This bill would have removed this authority from the air districts and given CARB authority to certify equipment and enforce regulations related to mobile refuelers. Was not heard in Assembly Transportation Committee.

2022 - Assembly Bill 467 (Grayson, Timothy), Smog Check: Exemption: Historic Vehicles (Dead)

Summary

Would have exempted vehicles from smog check requirements if they have a special license plate issued pursuant to section 5004 of the Vehicle Code. In order to meet the specifications of the aforementioned Vehicle Code, a vehicle would have needed to meet one of the three following requirements: Be (1) A motor vehicle with an engine of 16 or more cylinders manufactured prior to 1965, (2) A motor vehicle manufactured in the year 1922 or prior thereto, or (3) A vehicle which was manufactured after 1922, is at least 25 years old, and is of historic interest. Governor’s Veto Message

To the Members of the California State Assembly:

I am returning Assembly Bill 117 without my signature.

This bill codifies the Electric Bicycle Incentive Project (Project) to provide incentives to income-eligible individuals for the purchase of electric bicycles at participating retailers.

I support the author's intent and goals of this program, which is why the 2021 -22 Budget Act included $10 million in one-time funding for this Project. However, there is no ongoing source of funding for this Project.

With our state facing lower-than-expected revenues over the first few months of this fiscal year, it is important to remain disciplined when it comes to spending, particularly spending that is ongoing. We must prioritize existing obligations and priorities, including education, health care, public safety, and safety-net programs.

The Legislature sent measures with potential costs of well over $20 billion in onetime spending commitments and more than $10 billion in ongoing commitments not accounted for in the state budget. Bills with significant fiscal impact, such as this measure, should be considered and accounted for as part of the annual budget process.

For these reasons, I cannot sign this bill.

Would have extended until 2026, the 20 percent set-aside requirement for early commercial existing zero and near-zero-emission truck technology within CARB’s California Clean Truck, Bus, and Off-Road Vehicle and Equipment Technology Program, and would have created a set-aside for near-zero heavy-duty trucks within the 20 percent. The bill also would have redefined "near-zero-emission" to mean a vehicle with a no less than 14,001 pounds gross vehicle weight rating that is certified to a 0.02 grams per brake horsepower-hour (g/bhp-hr) low oxides of nitrogen emissions standard through December 31, 2026, and certified to a 0.01 g/bhp-hr low oxides of nitrogen emissions standard on and after January 1, 2027. 2022 – Senate Bill 1095 (Durazo, Maria Elena), Air Quality: Rules and Regulations: Socioeconomic Impacts Assessment (Dead)

Summary

Would have required CARB to conduct an assessment of the socioeconomic impacts, as defined, of a proposed rule or regulation with an economic impact of $10 million or more that will significantly affect air quality or emissions limitations. The bill also would have authorized CARB to contract with a third party to conduct the required assessment of socioeconomic impacts. The bill would have specified minimum standards for the assessment of socioeconomic impacts, and required CARB or a third-party contractor to include in the assessment of socioeconomic impacts, specified information and various economic analyses, along with the disproportionate impact of the proposed rule or regulation on specified race and ethnicities, as well as gay, lesbian, bisexual, and transgender individuals and women. The bill would have prohibited CARB from approving an assessment of socioeconomic impacts that fails to meet those requirements. The bill would have had similar provisions regarding third party contractor and disproportionate impact analysis for the local air districts. Held on suspense in the Senate Appropriations Committee.
