Summary

Would have exempted the operation of an alternative power source, as defined, to provide power to a critical facility, as defined, from any local, regional, or State regulation regarding the operation of that source.  The bill would have authorized providers of essential public services, in lieu of compliance with applicable legal requirements, to comply with the maintenance and testing procedures set forth in the National Fire Protection Association Standard for Emergency and Standby Power System, NFPA 110, for alternative power sources designated by the essential public services providers for the support of critical facilities.  Was not heard in the Assembly Utilities and Energy Committee.

Would have extended the Jobs and Economic Improvement through Environmental Leadership Act of 2011 (AB 900, Buchanan, Chapter 345, Statutes of 2011) until January 1, 2025.  The bill would have also expanded eligibility to include smaller housing projects and specified procedures for the quantification and mitigation of greenhouse gas emissions, including removing CARB’s role, authorizing the Office of Planning and Research to charge a fee for the greenhouse gas determination, and prioritizing on-site and local direct greenhouse gas emissions reductions over emission offset measures.  Failed passage on Senate Concurrence.

Would have authorized a local government to pass an ordinance, notwithstanding any local restrictions on adopting zoning ordinances, to zone any parcel for up to 10 units of residential density per parcel, if the parcel is located in a transit-rich area, a jobs-rich area, or an urban infill site.  The bill also would have required the Department of Housing and Community Development, in consultation with the Office of Planning and Research, to determine jobs-rich areas and publish a map of those areas every five years.  Held in the Assembly Appropriations Committee.
