California Air Resources Board

Requires all State agencies, including their departments, boards, offices, commissions, and conservancies, to consider the 30x30 goal when adopting, revising, or establishing plans, policies, or regulations, and shall ensure, to the extent feasible, that the plan, policy, or regulation is not inconsistent with the 30x30 goal. Was not heard in the Senate Committee on Governmental Organization.

Eliminates the continuous appropriation of 25% of the annual proceeds of the Greenhouse Gas Reduction Fund (GGRF) to the High-Speed Rail Authority on June 30, 2026, and beginning with the 2026–27 fiscal year, and until December 31, 2030, requires 25% of the annual proceeds of the GGRF to be transferred to the Motor Vehicle Fuel Account (MVFA). Beginning July 1, 2026, and before January 1, 2031, the bill reduces the rate of the tax imposed upon each gallon of fuel by a specified percentage based annually on the amount transferred to the MVFA from the GGRF. Failed passage in the Senate Environmental Quality Committee and was granted reconsideration.

Extends, until January 1, 2035, existing law that requires the California Transportation Agency, in consultation with the California Transportation Commission, to implement the road usage charge pilot program, as specified, and that currently repeals these provisions on January 1, 2027. Continuously appropriates 10% of auction proceeds in the Greenhouse Gas Reduction Fund to CARB for community air protection implementation, including, but not limited to, funding grants, providing technical assistance, supporting community participation, and incentives, further specified as including community air grants, cleaner technologies with a priority on zero-emission equipment, zero-emission charging infrastructure projects with a priority toward infrastructure that supports medium- and heavy-duty vehicles, and specified stationary sources that result in direct emission reductions of toxic air contaminants and criteria air pollution, including zero-emission technologies. Requires a battery supplier to be responsible for ensuring the end-of-life management of a vehicle traction battery and requires reporting information regarding the sale, transfer, or receipt of a vehicle traction battery or module to the Department of Toxic Substances Control (DTSC). The bill imposes related duties on a secondary user, a secondary handler, an auctioneer, all as defined, to report similar information regarding a vehicle traction battery or battery module to DTSC. The bill provides funding mechanisms for DTSC to implement the bill. CARB’s interest was conformity with technical specifications used in CARB’s regulations. Moved to the Assembly Inactive File.

Allows California gas corporations to include renewable natural gas interconnection in their rate base investments. Adds a provision regarding the displacement of conventional natural gas reducing greenhouse gas emissions as a potential eligibility element for California biomethane. Prohibits State agencies and local governments from adopting or enforcing a rule, regulation, resolution, or ordinance that directly or indirectly results in prohibiting the use of gas appliances in residential or nonresidential buildings, and the buying, selling, or use of gasoline-powered vehicles or equipment. Allows a local jurisdiction to count organic material used as a beneficial agricultural amendment towards its recovered organic waste procurement target under SB 1383 (Lara, Chapter 395, Statutes of 2016) if the material is processed at a facility authorized by the Department of Recycling and Resource Recovery using approved technologies and if the beneficial agricultural amendment is licensed for end use as an agricultural fertilizer by the Department of Food and Agriculture. Was not heard in the Assembly Natural Resources Committee.

Requires the California Environmental Protection Agency (CalEPA) to conduct a study on the costs of climate change to the State and requires responsible parties with greenhouse gas emissions greater than 1 billion metric tons globally from 1990 to 2024 to pay a cost recovery demand proportionate to their share of emissions compared to total anthropogenic greenhouse gas emissions. Authorizes responsible parties to pay the cost recovery demand in 20 annual installments, with the first installment equaling 10 percent of the cost recovery demand. Creates the Polluters Pay Climate Fund and continuously appropriates the funding generated by the cost recovery demands to the Fund for projects that avoid, mitigate, repair, or adapt to negative climate change impacts, with a minimum of 40 percent of funded projects benefitting environmental justice populations.
