California Air Resources Board

Adds pipelines transporting carbon dioxide to the State requirements for pipelines carrying hazardous liquids but only allows those pipelines to operate after the State Fire Marshal adopts regulations governing those pipelines. The bill requires the State Fire Marshal to adopt regulations governing intrastate pipelines transporting carbon dioxide, that are equivalent to draft federal regulations, as specified. The bill authorizes the State Fire Marshal to amend the regulations to provide other safety standards, as specified, and requires pipelines transporting carbon dioxide to or from carbon dioxide capture, removal, or sequestration projects to comply with these regulations. Specifies that the regulations shall be considered emergency regulations. The bill requires a pipeline operator to conduct an analysis, as specified, of the potential for harm to sensitive receptors located within the emergency planning zone, and requires the operator to submit an emergency planning zone inventory and map, as specified. The bill requires a lead agency to prepare and certify an Environmental Impact Report for the construction of a pipeline transporting carbon dioxide and provide notice to sensitive reporters, as specified. Finally, the bill prohibits approval of carbon dioxide pipelines that were previously used to transport other liquids or gases.

Would have required the owner of an aircraft based in the State to register the aircraft with the Department of Motor Vehicles, as specified. Would have created the Aircraft Registration Account and requires the Department of Motor Vehicles (Department) to determine an appropriate registration fee to be deposited in the account. Would have required the fee to be used for the Department's cost of administration, as well as to combat the detrimental environmental impacts of aircraft emissions, including particulate matter emissions. Was not heard in the Senate Transportation Committee at the request of the author.

Removes reported emissions of greenhouse gases, criteria pollutants, and toxic air contaminants from all sectors covered by the scoping plan that CARB must report on annually to the Joint Legislative Committee on Climate Change Policies and instead requires the report to contain unspecified topics related to the scoping plan. The bill also removes these topics from the informational report CARB must present at an annual meeting of the Joint Legislative Committee on Climate Change Policies and instead requires the report presented to cover topics related to the Scoping Plan, as directed by the joint committee. Finally, the bill removes a requirement for the report to evaluate emissions trends and instead include programs that may influence the implementation of the Scoping Plan.

The bill requires CARB to develop a public process with local air districts to discuss options for remedying the report, which the airport must resubmit within 120 days. The bill requires CARB to notify the Governor's Office of Business and Economic Development (GO-Biz) upon approval of a report and requires GO-Biz to provide technical assistance to qualified airports. The bill requires airports with greater than 50,000 private takeoffs to report to relevant local air districts on their efforts to mitigate impacts to disadvantaged communities. Summary 

This bill requires corporations with total annual revenues over $500 million and operating in California, beginning December 31, 2024, and annually thereafter, to develop a report on its climate-related financial risks and submit them to a climate reporting organization contracted by CARB, unless it already develops a similar report, as specified. The bill requires the climate reporting organization to prepare a public report that reviews the disclosure reports, an analysis of systemic and sector-wide climate-related financial risks, and identification of inadequate reports. The bill requires CARB to set a fee to cover its costs and adopt regulations authorizing it to seek administrative penalties for entities that fail to report, not exceeding $500,000 in a reporting year.

This bill also would have required CARB to encourage natural gas procurement on behalf of the State to shift to certified natural gas producing low methane emissions, where feasible, cost effective, and in the best interests of ratepayers.
