Summary 

Would have expanded the regulation of intrastate pipelines to pipelines used for the transportation of carbon dioxide. The bill would have exempted intrastate gas pipelines regulated by the Public Utilities Commission and required the State Fire Marshal to adopt regulations no later than January 1, 2025, that establish procedures for maintaining, testing, and inspecting valves on intrastate hazardous liquid and carbon dioxide pipelines. Would have required CARB to develop a carbon offset credit for whole orchard recycling. The bill would have appropriated an unspecified sum from the General Fund to California Department of Food and Agriculture for purposes of providing grants to the University of California Agriculture & Natural Resources division and the California State University for research to assess the co-benefits from healthy soil practices. Summary 

Would have established the policy of the State to achieve net zero greenhouse gas (GHG) emissions as soon as possible, but no later than 2045. The bill would have required CARB to ensure that by 2045, Statewide anthropogenic greenhouse gas emissions are reduced to at least 90 percent below 1990 levels. The bill would have required CARB to work with relevant State agencies to ensure the Scoping Plan updates contain measures to achieve net zero greenhouse gas emissions, and to establish criteria for the use of natural-based climate solutions and carbon dioxide removal technologies. The bill would also have required CARB to identify interim 5-year GHG reduction goals beginning in 2025, and report to the Joint Legislative Committee on Climate Change Policies on progress. Summary 

Would have required the Department of General Services by January 1, 2024, to establish and publish a maximum acceptable global warming potential for concrete, as specified. The bill would have, beginning January 1, 2022, required an awarding authority to require a winning bidder for an eligible project to submit an Environmental Product Declaration developed in accordance with specified standards prior to installation of any concrete products.  Was not heard in the Assembly Natural Resources Committee.

Summary 

Would have required CARB, by July 1, 2024, to develop a plan to reduce aviation greenhouse gas emissions, including a sustainable fuels target for the aviation sector of at least 20 percent by 2030. The bill would have required the plan to include strategies to increase adoption of sustainable aviation technologies, and incentive amounts necessary to encourage aircraft to use cleaner fuels. Finally, the bill would have required CARB, by July 1, 2024, upon appropriation by the Legislature, to implement the plan.

Governor’s Veto Message 

To the Members of the California State Assembly:

I am returning Assembly Bill 1322 without my signature.

This bill requires the California Air Resources Board (CARB), on or before July 1, 2024, to develop a plan to reduce greenhouse gas emissions through the production and use of sustainable aviation fuels. This bill would also require CARB, on or before July 1, 2024, to commence implementation of the plan to achieve these goals.

While my Administration appreciates the intent of this bill, there are existing opportunities for credit generation from sustainable aviation fuel production under the state's Low Carbon Fuel Standard.

For these reasons, I cannot sign this bill.

Establishes the policy of the State to achieve carbon neutrality as soon as possible, but no later than 2045 and maintain net negative greenhouse gas emissions thereafter, and to ensure that by 2045 Statewide anthropogenic greenhouse gas emissions are reduced at least 85 percent below 1990 levels. The bill requires CARB to ensure that the Scoping Plan identifies and recommends measures to achieve carbon neutrality, and to identify and implement policies and strategies that enable carbon dioxide removal and carbon capture, utilization, and storage technologies to complement these emission reductions.
