Governor’s Veto Message

To the Members of the California State Assembly:

I am returning Assembly Bill 117 without my signature.

This bill codifies the Electric Bicycle Incentive Project (Project) to provide incentives to income-eligible individuals for the purchase of electric bicycles at participating retailers.

I support the author's intent and goals of this program, which is why the 2021 -22 Budget Act included $10 million in one-time funding for this Project. However, there is no ongoing source of funding for this Project.

With our state facing lower-than-expected revenues over the first few months of this fiscal year, it is important to remain disciplined when it comes to spending, particularly spending that is ongoing. We must prioritize existing obligations and priorities, including education, health care, public safety, and safety-net programs.

The Legislature sent measures with potential costs of well over $20 billion in onetime spending commitments and more than $10 billion in ongoing commitments not accounted for in the state budget. Bills with significant fiscal impact, such as this measure, should be considered and accounted for as part of the annual budget process.

For these reasons, I cannot sign this bill.

Summary

Would have extended until 2026, the 20 percent set-aside requirement for early commercial existing zero and near-zero-emission truck technology within CARB’s California Clean Truck, Bus, and Off-Road Vehicle and Equipment Technology Program, and would have created a set-aside for near-zero heavy-duty trucks within the 20 percent. The bill also would have redefined "near-zero-emission" to mean a vehicle with a no less than 14,001 pounds gross vehicle weight rating that is certified to a 0.02 grams per brake horsepower-hour (g/bhp-hr) low oxides of nitrogen emissions standard through December 31, 2026, and certified to a 0.01 g/bhp-hr low oxides of nitrogen emissions standard on and after January 1, 2027. 2021 - Assembly Bill 1312 (Rodriguez, Freddie), Hydrogen Fuel Standard and Tax Credit (2-Year)

Would require CARB to phase in a 100 percent green and zero carbon hydrogen fuel standard by 2045. The bill would provide a ten year, steadily declining set of personal and corporate income tax credits for green hydrogen production and distribution, as well as for hydrogen fueling stations. CARB would annually certify green hydrogen production and available hydrogen fueling stations to the Franchise Tax Board. Green hydrogen is defined to be hydrogen not produced from fossil fuel feedstock sources. Was not heard in the Assembly Natural Resources Committee.
