2024 – Senate Bill 934 (Gonzalez, Lena), Zero-emission Freight Infrastructure: Interagency Coordination: Report (Dead)

Summary 

Would have required the California Transportation Agency and the California Energy Commission to jointly convene a Zero-Emission Freight Central Delivery Team (California Department of Transportation, CARB, California Public Utilities Commission, Governor’s Office of Business and Economic Development, among others) to lead the statewide coordination of zero-emission freight infrastructure planning and implementation. This would have built off the recommendations of the assessment required by SB 671 (Gonzalez, Chapter 769, Statutes of 2021). This bill would have required the Central Delivery Team to promote the timely and equitable deployment of freight zero-emission vehicle (ZEV) infrastructure by:  1) Strategically selecting project locations for freight ZEV infrastructure; 2) Coordinating actions among State agencies, utilities, and other stakeholders and developing a process to include nongovernmental stakeholders; 3) Identifying leads from regional transportation planning agencies, ports, State agencies, and other stakeholders; 4) Identifying available funding sources and public private partnership models; 5) Developing standardized station deployment models; and 6) Working with community colleges and ports to support training of skilled freight workers. The bill also would have required a report to be delivered every five years, with the first due on or before March 1, 2026, that outlined the team’s actions in the last year, best practices for planning and implementation, policy recommendations, and an assessment of the State's progress. Would have required the freight coordinator, as appointed by the Governor, to serve as the advisory and coordinating entity for the Governor’s Office of Business and Economic Development (GO-Biz). The freight coordinator would have advised and coordinated policies that promote the growth, competitiveness, and sustainability for freight and the supply chain across the State, and would have promoted and assessed the continued economic vitality and sustainability of the freight sector. The bill would have required the freight coordinator to advise the Governor and GO-Biz director on issues affecting the State’s freight and supply chain, including economic strategy, investment, and improvements in technology. The freight coordinator would have also advised the Governor and director on policy and administrative regulations affecting the State’s freight and supply chain. As related to CARB, the bill would have required the freight coordinator to work directly with specified State agencies, including CARB, to address and discuss ongoing freight and supply chain issues. 2024 – Assembly Bill 2796 (Alvarez, David), Equitable Access to Zero-Emissions Vehicles Fund (Dead)

Summary

Would have established the Equitable Access to Zero-Emission Vehicles Fund and would make moneys in the fund available, upon appropriation by the Legislature, to establish a program no later than January 1, 2025, to offer rebates for the purchase of zero-emission vehicles to underserved individuals, as specified. This bill would have also required CARB to submit a report to the Legislature every two years, starting on or before December 31, 2026, that describes the rebates, recommendations to improve the equitable distribution of the Fund, and any recommendations to better complement the Clean Cars 4 All Program. Would have directed CARB to work with the California Transportation Commission (CTC) and Department of Housing and Community Development to create guidance for the programming of projects that expand the physical footprint of a highway to address the impact on the highest 10% of CalEnviroScreen communities. The bill would have required that this guidance be incorporated into the programming cycle, starting January 1, 2028. The bill would have required CTC to "establish a target" to use 15% of annual funds for investments in zero-emission infrastructure, beginning in cycle starting after January 1, 2025, and increase that by 5% each year, until setting the goal of 50%. 2023 – Assembly Bill 1267 (Ting, Phil), Zero-emission vehicle incentive programs: gasoline superusers (2-Year)

Summary 

Requires CARB to, upon appropriation by the Legislature, ensure that beginning January 1, 2025, an additional incentive is awarded under any light-duty ZEV incentive program to program participants who qualify as a gasoline or diesel superuser, as determined by CARB. Additionally, the bill requires CARB, on or before January 1, 2025, to develop and implement a strategy for doing all of the following: (1) Identifying the drivers who use the most gasoline or diesel and are low income or moderate income; (2) Expediting the replacement of gasoline- or diesel-powered vehicles of these drivers; (3) Identifying barriers that prevent gasoline or diesel superusers from accessing ZEV incentive programs; (4) Developing outreach protocols. The bill also requires CARB to produce a biennial report beginning on January 1, 2025 which includes: (1) gasoline or diesel emissions reduced per dollar spent on ZEV programs; (2) impacts of ZEV incentive program spending in terms of quantifiable emissions reductions and transportation savings among low- to moderate-income individuals; (3) changes in annual gasoline and diesel use at local levels by census tract or ZIP Code. Summary 

This bill requires CARB to authorize public agency utilities to purchase replacements for traditional utility-specialized vehicles that are at the end of life, as determined by CARB in consultation with public agency utilities, when needed to maintain reliable service and respond to major foreseeable events, including, but not limited to, severe weather, wildfires, natural disasters, and physical attacks, without regard to the model year of the vehicle being replaced. The bill also states that in determining the daily usage of a medium- or heavy-duty vehicle, a public agency utility may provide comprehensive usage data for a class of vehicles that does not exclusively rely on the lowest mileage reading and does not exclude the highest usage days.

Summary 

Requires CARB, by January 1, 2026, not to enforce any regulation requiring the purchase and use of zero-emission trucks with greater than 8,500 pounds gross vehicle weight rating operating at land ports of entry, which the bill defines as land ports of entry on the California-Mexico border within a commercial zone. The bill also requires CARB, after January 1, 2026, if enforcing regulations requiring the purchase and use of zero-emission trucks with greater than 8,500 pounds gross vehicle weight rating operating at a land port of entry within a commercial zone, then CARB must have the burden of proof that a regulated fleet operator has reasonable access to an economically feasible charging or fueling infrastructure. The bill also provides a number of exemptions to heavy-duty truck electrification regulations. Was not heard in the Assembly Transportation Committee.
