Summary

Would have extended the Vehicle Dismantling Industry Strike Team indefinitely so that the Department of Motor Vehicles (DMV) could continue to review and coordinate enforcement and compliance activity related to unlicensed and unregulated automobile dismantling with the Department of Tax and Fee Administration, California Environmental Protection Agency, Department of Toxic Substances Control, State Water Resources Control Board, Department of Resources Recycling and Recovery, and CARB. The bill would have also required the DMV, in collaboration with the agencies listed, to submit a report to the Legislature with additional information and analysis on progress made since the 2024 legislative report. Held on suspense in the Assembly Appropriations Committee.

2022 – Senate Bill 1069 (Umberg, Thomas), State Grant Programs: Negotiated Cost Rate Agreements (Dead)

Summary

Would have required the Department of General Services to establish, by July 1, 2023, a State standard negotiated cost agreement for awarding State grants that are created on or after July 1, 2023, to grantees that do not have an existing negotiated indirect cost rate agreement and cost allocation policy approved by the federal government. The bill would have required any State grant program created on or after January 1, 2023, to require the State agency administering the grant to use the same terms as contained in the grantee’s existing negotiated indirect cost rate agreements and cost allocation policies approved by the federal government. The bill would have required a State agency administering those programs to use, on and after July 1, 2023, the same terms as contained in the grantee’s State standard negotiated cost agreement. The bill would have required these State agencies to authorize a grantee that is a nonprofit organization and that does not have an existing federal negotiated indirect cost rate agreement or existing State standard negotiated cost agreement to instead be compensated for indirect costs pursuant to specified methods. 2021 – Senate Bill 366 (Umberg, Thomas), Automobile Dismantling Task Force (Chaptered)

Summary

Reconstitutes the Vehicle Dismantling Industry Strike Team, which sunset January 1, 2020, and is comprised of several State agencies, including CARB and California Environmental Protection Agency. The bill requires the Vehicle Dismantling Industry Strike Team to submit a report to the Legislature by January 1, 2024, that includes: the number of unlicensed dismantlers investigated and the number of investigations that resulted in enforcement actions, including theft of catalytic converters; the number of locations used for unlicensed automobile dismantling and the number of actions taken; compliance progress; and any statutory, administrative, or regulatory gaps that exist. Senate Bill 366 sunsets the Vehicle Dismantling Industry Strike Team on January 1, 2025. Additionally, the bill changes the fine structure for violations by unlicensed vehicle dismantlers.

2020 - Senate Bill 1330 (Umberg, Thomas), Sales and Use Tax Law: Zero Emissions Vehicle Exemption (Dead)

Summary

Would have exempted, on or after January 1, 2021, an electric or a hybrid electric vehicle, for which the final listing price is not greater than $25,000, from existing State sales and use tax laws on retailers measured by the gross receipts from the sale of personal property sold at retail or on the storage, use, or other consumption.  Remains in the Senate Rules Committee.
