Summary

Would have authorized a State agency to temporarily remove public documents from digital access if a justifiable impediment existed that prevented a State agency from bringing the document into compliance with the State’s accessibility standards.  The bill would have required the Director of Technology to verify that such an impediment prohibited full compliance, and would have required the State agency to cite the reason for the document’s removal and list options and instructions for how to access the document offline.  The bill would have made any document removed after October 14, 2017, subject to these requirements.  Was not heard in the Senate Governmental Organization Committee.

Summary

Would have required the Small Business Advocate and each State agency’s small business liaison to provide technical advice and assist small businesses in filing petitions to request the adoption, amendment, or repeal of a regulation.  The bill would have authorized a small business liaison to advocate for or against the adoption, amendment, or repeal of a regulation that is requested by petition.  The bill would also have required the Small Businesses Advocate to provide counsel and offer recommendations to State agencies who receive those petitions from small businesses.  The bill would have authorized the Small Businesses Advocate and the State agency small business liaison to issue written comments as to the validity of a submitted petition, and would have required the advocate and the agency liaison to offer a petitioner at least one meeting to discuss the contents of a petition.  Held on suspense in the Assembly Appropriations Committee.

Summary

Would make a public agency liable for all damages proximately caused by a negligent or intentional violation of the requirements of the Information Practices Act of 1977.  The bill would have also prohibited an agency from selling, renting, or exchanging for a commercial purpose the personal information that the agency holds without the consent of the person to whom that information applies.  Remains at the Assembly Desk.

Would have established the Energy, Environment, and Economy Council (Council) with 16 members, as specified.  The bill would have required the Council to engage with stakeholders, subject matter experts, and State and local agencies with jurisdiction relevant to environmental protection and economic vitality in order to determine the policies that can be implemented to meet the State’s environmental goals, while avoiding harm to the State’s economy and maintaining specified protections.  The bill would have required the Council, by July 1, 2022, to submit a report to the Legislature that would have made recommendations on appropriate policies to achieve the above-stated environmental goals, while maintaining specified protections, ensuring consumer choice is not compromised, and avoiding harm to the State’s economy.  Was not heard in the Assembly Natural Resources Committee.

Would have required the Secretary of State to adopt emergency regulations to provide appropriate and timely guidance to public entities and the public generally regarding signature requirements and to make regulatory changes needed no later than March 1, 2022, in accordance with the Administrative Procedure Act.  The bill would have made such adopted emergency regulations effective only until nonemergency, final regulations are adopted and become effective through the regular rulemaking process.  Was not heard in the Assembly Judiciary Committee.
