General
What does Assembly Bill 794 (2021) require?
Assembly Bill (AB) 794 (2021) requires, among other things, that fleet purchasers of new drayage and short-haul trucks participating in applicable incentive programs funded or administered by the California Air Resources Board (CARB) to attest to labor law compliance, and to produce specific information. Drayage and short-haul fleets who lease rather than purchase the vehicle must comply with similar requirements under AB 2737 (2022).
When did the requirements of AB 794 take effect?
The requirements took effect July 2022.
Does AB 794 apply to me?
AB 794 applies to fleets that participate in applicable incentive programs to purchase or lease one or more new drayage or short-haul trucks. The California Code of Regulations defines a fleet as one or more vehicles, owned by a person, business, or government agency traveling in California and subject to this regulation. (Cal. Code Regs., tit. 13, § 2025, subd. (d)(28).)
Attestations
What is an attestation?
An attestation is an official verification of something as true or authentic. AB 794 requires fleet purchasers to attest that they do not have an applicable law violation at the time of applying for the incentive, are not on the list maintained by the Division of Labor Standards Enforcement, and will maintain full ownership and operational control of the vehicle(s) or any individual using or driving the vehicle. It is a violation of State law to submit false or misleading information to obtain State funds.
Who is required to submit a fleet attestation?
Fleet purchasers and lessees participating in applicable incentive programs funded or administered by CARB for the purchase of new drayage and short-haul trucks must submit a fleet attestation.

How often do I need to submit a fleet attestation?
You must submit your attestation when you apply for an applicable incentive program and then renew your attestation on a yearly basis for the term of your incentive agreement.
Rental and Leasing Entities
What if I am a rental or leasing entity applying for incentives?
AB 2737 excludes rental or leasing entities from AB 794 fleet purchaser requirements. However, for leases greater than one year, you are required to notify the lessee that they must comply with AB 794 fleet purchaser requirements.
What if I am leasing a vehicle that was purchased with applicable incentive funding?
If the lease agreement is greater than one year, AB 2737 requires the lessees to comply with the AB 794 fleet purchaser requirements, including submittal of a yearly attestation. Lessors are required to notify lessees of the AB 794 fleet purchaser requirements.
Complaints
Do I need to provide my name and contact information?
You can submit a complaint anonymously. However, you are encouraged to provide your contact information when submitting a complaint. This will allow CARB staff to contact you if there are any questions about the complaint.
What should I do if I know a fleet is receiving applicable incentive funding and they are not in compliance with the requirements of AB 794?

What information do I need to submit for an AB 794 complaint?
Submit company information, your contact information, and the details of your complaint. If available, include supporting documents like photos, contracts, pay stubs, or emails. Required fields are marked with a red asterisk.
What happens after I submit a complaint?
You will receive confirmation after you submit a complaint. CARB staff will review the complaint to determine if further investigation is necessary.
