Assembly Bill (AB) 794 (2021) directs the California Air Resources Board (CARB) to require purchasers of new drayage and short-haul trucks participating in applicable incentive programs funded or administered by CARB to attest and remain in compliance with applicable standards and labor laws.
Assembly Bill (AB) 2737 (2022) provides some exclusions on the applicability of AB 794 for rental and leasing entities who participate in an applicable incentive program to purchase drayage and short-haul trucks. For lease agreements greater than one year, the rental or leasing entity is required to notify lessees that they must comply with the AB 794 requirements applicable to fleet purchasers.
The Incentives Enforcement Section is responsible for verifying that fleets receiving funds from applicable incentive programs meet the terms of their incentive agreements, including but not limited to AB 794 requirements.
