Homelegance, Inc. Settles For $13,500
In April 2023, the California Air Resources Board (CARB) reached a settlement with Homelegance, Inc., of Fremont, California in the amount of $13,500 for the company’s violation of the Airborne Toxic Control Measure to Reduce Formaldehyde Emissions from Composite Wood Products (ATCM), as codified in California Code of Regulations, title 17, section 93120 et seq.
Homelegance, Inc. sold, supplied, and offered for sale in California bed frames that contained noncompliant hardwood plywood bed slats. The Quad Twin Bunk Bed: B2043CN bed contained formaldehyde emissions above the limits set forth in the ATCM. Homelegance, Inc. also did not put a statement of compliance on its customer invoices or bills of lading, which is required by the ATCM.
To come into compliance, Homelegance, Inc. has implemented a compliance plan to test four random products a year. Homelegance, Inc. also updated its customer invoices to have a statement of compliance to be incompliance with the ATCM. The penalty amount will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
