Freshko Produce Services Case Settles for $3,037.50
In April 2013, Freshko Produce Services agreed to pay $3,037.50 in penalties for violating air quality regulations: $2,278.13 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $759.37 will go to Peralta Community College District to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program.
An investigation by the Air Resources Board (ARB) showed that Freshko Produce Services failed to: (1) properly self-inspect a portion of its fleet of heavy-duty diesel vehicles to assure the trucks met state smoke emission standards, (2) to bring a portion of its fleet of drayage trucks into compliance with applicable emission requirements, (3) to register a portion of their drayage trucks with the Drayage Truck Registry (DTR), (4) to only dispatch drayage trucks that meet emission standards and are registered with the DTR, and (5) to bring a portion of their fleet of Transport Refrigeration Units (TRUs) in compliance with the applicable in-use performance standards. ARB documented violations as they related to the Periodic Smoke Inspection Program (PSIP), the Drayage Truck Regulation, and the TRU ATCM. To settle the case, Freshko Produce Services agreed to the $3,037.50 penalty and to comply with the Periodic Smoke Inspection Program, the Drayage Truck Regulation, the TRU ATCM, and other ARB programs.
