Capay, Inc. Settles For $3,000
In August 2021, the California Air Resources Board (CARB) and Capay, Inc., with its principal location in Sacramento, California, reached a settlement agreement in the amount of $3,000.00 for penalties resulting from violation of CARB’s Regulation for the Management of High Global Warming Potential Refrigerants for Stationary Sources (RMP Regulation). The $3,000.00 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality.
Capay, Inc. is a food distribution business that operates one medium-sized refrigeration system with a full charge of less than 2,000 pounds of a high global warming potential refrigerant. Capay, Inc. was referred to CARB staff for enforcement action due to failure to perform annual calibrations on an automatic leak detection system for reporting years 2018 and 2020, as specified in California Code of Regulations (CCR), title 17, section 95386(a)(5) (17 CCR § 95386(a)(5)). Capay, Inc. fully cooperated with the investigation, came into compliance quickly and put into place policies and procedures to prevent this issue from occurring in the future.
