Winplus North America, Inc. Settles For $30,000
In February 2023, the California Air Resources Board (CARB) reached a settlement with Winplus North America, Inc. (Winplus), with its principal location in Costa Mesa, California, for the company’s violation of CARB’s air quality regulations.
CARB staff conducted an investigation that revealed Winplus sold, supplied, offered for sale and/or manufactured Type S Reflective Spray Peelable and Type S Reflective Spray Washable for use in California. The Type S Reflective Spray Peelable is a Nonflat Coating category product that exceeded the reactivity standards and prohibited toxics as specified in California Code of Regulations, title 17, sections 94522(a) and (e). Both Type S Reflective Spray Peelable and Type S Reflective Spray Washable failed to display applicable category and applicable reactivity limit on product labeling as specified in California Code of Regulations, title 17, section 94524(b).
The penalty of $30,000 is for 0.97 tons of excess reactivity emissions, 0.65 tons of prohibited toxic emissions, and three days of administrative penalty. The $30,000 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California’s air quality. Winplus cooperated fully with CARB to resolve this matter. To come into compliance, Winplus is no longer offering the products Type S Reflective Spray Peelable and Type S Reflective Spray Washable for sale in California.
