On April 13, 2006, Kinder Morgan reported that their routine testing had found MTBE in excess of the cap limit in the pipeline on the way to San Diego. The gasoline was imported by Vitol on the marine vessel Bow Lion, discharged to the KM port facility, and purchased by BP, who was shipping it to their San Diego facility. Testing of retained samples taken upon discharge of the vessel show that the MTBE was high as it came off the vessel. The case was settled for $130,000 on December 19, 2007. On August 29, 2006, routine testing of CARBOB being imported on the marine vessel "Bow Pride" found that the sulfur content of the fuel in compartment 4P was 28 parts per million (ppm), although the predictive model specified a maximum sulfur content of 22 ppm. The case was settled for $20,000 on December 19, 2007.
