Vi-Jon, Inc., Garfield Beach CVS, L.L.C., Longs Drugs Stores California, L.L.C., and Rite Aid Corporation Case Settles for $199,500
On November 15, 2016, two cases were settled in connection with the CVS and Rite Aid private labeled Hair Tonic products. These products were manufactured by Vi-Jon, Inc. and qualified as hair styling products. The products contained concentrations of Volatile Organic Compounds (VOC) exceeding the two percent by weight VOC limit for the category of Hair Styling Product: all other forms.
The excess VOC emissions from the sales of Rite Aid Hair Tonic product were 3.45 tons. Vi-Jon and Rite Aid agreed to pay a penalty of $77,335. The excess VOC emissions from the sales of CVS Hair Tonic product were 5.45 tons. Vi-Jon and CVS agreed to pay a penalty of $122,165. Both Rite Aid and CVS have since removed the non-compliant hair styling products from their California stores shelves and Vi-Jon has since reformulated and/or relabeled the products to fit the hair shine category. The two combined cases, CP13-06-05 and CP13-12-01, were settled with all the involved companies on November 15, 2016, for $199,500.
