Unified Western Grocers, Inc. Case Settles for $23,000.00
Between 2008 and 2012, Unified Western Grocers supplied to California retailers a non-compliant Peak Windshield Wash and Deicer -20F product in pre-mixed one-gallon size containers that were sold in California. The named product not only exceeded the 1% VOC limit specified in Title 17, CCR, Section 94509(a) for automotive windshield washer fluids sold in non-Type “A” areas of California, but also the 25% VOC limit in the Type “A” areas of California. This was the second violation for Unified Western Grocers for this category of products and the amount of excess VOC emissions associated with the violations was 0.81 tons. A settlement agreement was executed on February 6, 2013 and Unified Western Grocers paid $23,000 to settle the case.
