Ultramar Inc. Case Settles for $22,500.00
In October 2013, Ultramar Inc., dba Valero Wilmington Refinery paid $22,500 in penalties for supplying diesel in violation of California diesel fuel regulations. In May 2011, Valero supplied more than 28,000 gallons of diesel fuel which was not certified CARB diesel and notification was not made until after the start of transfer from its Wilmington Refinery. California’s diesel fuel regulation requires producers and importers to report their fuel specifications prior to the sale, offer for sale, or supply into the California market. During normal supply of a certified diesel tank, it appears the tank line was accidentally opened causing the mixing of certified diesel fuel with uncertified diesel fuel. As a result, the non-compliant diesel mixture was supplied to the local truck rack, prior to certification. The violation was discovered then self-disclosed. Audits by Enforcement staff verified the violation. Valero took steps to investigate, locate and recertify the non-compliant diesel fuel.
