Tom’s Equipment Rental Case Settles for $4,000
Tom’s Equipment Rental paid $4,000.00 in penalties for violating air quality regulations: $3,000.00 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $1,000.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in December 2015.
An investigation by the Air Resources Board (ARB) showed that Tom’s Equipment Rental failed to: (1) report all vehicles with engines subject to the regulation for which it elected to utilize the compliance options provided in the Truck and Bus (TB) regulation, and (2) bring two of its Transport Refrigeration Units (TRU) into compliance with the applicable in-use performance standards. ARB documented violations as they related to the TB regulation and the TRU Airborne Toxic Control Measure. To settle the case, Tom’s Equipment Rental agreed to the $4,000.00 penalty and to comply with TRU and TB regulations, and other ARB programs.
