Tesoro Refining & Marketing Co. Case Settles for $226,250
Tesoro Refining & Marketing Co. (Tesoro), paid $226,250.00 in penalties for violating the California Reformulated Gasoline Regulation as codified in California Code of Regulations (CCR), title 13, sections 225-2273.5. et seq. (13 CCR § 2250-2273.5) and the California Diesel Fuel Regulations as codified in CCR, title 13, sections 2281-2285 and title 17 CCR section 93114. et seq. (13 CCR § 2281-2285 and 17 CCR § 93114)
Samples collected during a routine inspection revealed an exceedance of the aromatic hydrocarbon content limit specified in the Predictive Model notification submitted by Tesoro.
Tesoro voluntarily disclosed a violation of the diesel regulation to CARB. An investigation by CARB confirmed an exceedance of the sulfur content limit specified in the diesel fuel regulation.
Tesoro agreed to pay a total of $226,250.00. $200,000.00 for ten days in violation of the aromatic limit or a per unit penalty of $20,000.00 and $26,250.00 for three days of violation of the sulfur limit or a per unit penalty of $8,750.00
Tesoro is now in compliance of title 13, sections 225-2273.5 and took immediate action to mitigate the incident and to bring the diesel fuel back into compliance.
