California Air Resources Board

Requires a local air district without a specified rule on emergency backup generators, as of January 1, 2026, that adopts such a rule, to include provisions that allow the operator of a critical facility to use a permitted emergency backup generator in exceedance of the applicable runtime and testing and maintenance limits if specified conditions are met. The bill specifies that a critical facility is allowed to exceed applicable limits and provide evidence of having taken demonstrable steps toward implementing the use of backup power technologies that meet or exceed emission standards set by CARB. Would have exempted collector motor vehicles from smog checks if they were manufactured prior to the 1981 model year, had been assigned a historical vehicle identification plate, and were insured as a collector motor vehicle. The bill, beginning January 1, 2028, would have expanded the exemption by one model year, every year, for 5 years. Held on suspense in the Assembly Appropriations Committee.

Would have required CARB to create the Advanced Clean Fleets Regulation Appeals Advisory Committee to review appeals for denied requests for exemptions from CARB's Advanced Clean Fleets (ACF) regulation. This bill would have also expanded existing ACF emergency vehicle exemptions to vehicles reasonably anticipated to respond to emergency situations or vehicles supporting those efforts. Would have required the Department of General Services (DGS) to require a light-duty vehicle supplier for State vehicle fleets to certify that the raw materials utilized for the manufacturing of the supplied vehicles were not mined by child labor. This bill would have also required the vehicle supplier to certify to DGS the locations and hourly wage of the workers that mined the raw materials. This bill also would have required DGS to post on its website the specified information provided by the vehicle supplier. Held on suspense in the Senate Appropriations Committee.

Would have required, on or before July 1, 2027, the Office of Land Use and Climate Innovation (LUCI) to consult with regional, local, State, and federal agencies to develop a technical advisory on thresholds of significance for greenhouse gas and noise pollution effects on the environment to assist local agencies. The technical advisory would have provided suggested thresholds of significance for all areas of the State, as specified, and would have provided that lead agencies may elect to adopt the suggested thresholds of significance. Would have required CARB to expand its incident air monitoring program to provide support for a regional network of air quality incident response centers operated by air districts, including at least one located in the South Coast Air Quality Management District. This bill would have required CARB and each district that operates an air quality incident response to coordinate to provide emergency air monitoring response for disasters or other crises impacting air quality and public health in the State. Funding provided to CARB could have been used for planning and maintaining centers, air quality collection and modeling, research studies, training and preparedness, and staff resources, including a State Air Quality Health Officer. Exempts "bucket trucks" from the Advanced Clean Fleet Regulation zero-emission vehicle (ZEV) requirements. This bill prohibits CARB from implementing any regulation that required the procurement of ZEVs for entities that operate specified emergency telecommunications vehicles.
