Summary

Revokes all CARB authority to adopt, revise, or repeal regulations and declares that any law granting authority to or requiring CARB to adopt, revise, or repeal regulations, or take an action that requires exercising regulatory authority, instead be read as only authorizing CARB to provide advice and propose measures to the Legislature for statutory enactment. The bill requires CARB to provide advice and propose measures to the Legislature for statutory enactment regarding its duties. The bill declares that it does not invalidate or repeal any regulation adopted by CARB before January 1, 2026. Failed passage in the Senate Environmental Quality Committeeand was granted reconsideration.

The bill would have required the Office to draft and assist in the preparation, consideration, amendment, and repeal of regulations for a State agency, before the State agency submits a proposed action regarding that regulation to the Office of Administrative Law for publication in the California Regulatory Notice Register. Summary 

Would have required CARB to create the Advanced Clean Fleets (ACF) Regulation Appeals Advisory Committee to review appeals for denied requests for exemptions from CARB's ACF Regulation. The Advisory Committee would have included representatives from CARB, the California Public Utilities Commission (CPUC), the California Energy Commission (CEC), Department of General Services (DGS), California Department of Transportation (CalTrans), a transit agency, a regional transportation agency, and members from private fleet owners, state and local government experts on fleets, investor-owned utilities (IOU) representatives, and electric vehicle (EV) vehicle manufacturing industry experts. This bill failed passage in the Senate Environmental Quality Committee.

Summary

Would have required, upon appropriation by the Legislature, Department of Forestry and Fire Protection (CalFire), the Office of Emergency Services (OES), and the Department of Toxic Substances Control (DTSC), in consultation with relevant academic and research institutions, government agency, and educational institution, to form a workgroup related to exposure of toxic heavy metals after a wildfire. The bill would have required the workgroup to take certain actions, including establishing best practices and recommendations for wildfire-impacted communities and first responders to avoid exposure to heavy metals after a wildfire. The bill would have authorized CalFire to contract with public universities, research institutions, and other technical experts to support the work of the workgroup. The bill would have required CalFire, OES, and DTSC to report their findings to the Legislature by January 1, 2026. Held on suspense in the Senate Appropriations Committee.
