Swisher Acquisition, Inc. Case Settles for $16,125.00
In July 2013, Swisher Acquisition Inc. (Swisher) agreed to pay $16,125.00 in penalties to the California Air Pollution Control Fund for violating air quality regulations. An investigation by the Air Resources Board (ARB) showed that Swisher failed to comply with the small off-road engine regulation by neglecting to certify evaporative emissions components prior to import and sale in California. Although not submitted for certification approval, the units would have met ARB certification standards. To settle the case, Swisher agreed to the $16,125.00 penalty and to comply with the 13 California Code of Regulations section 2400(a)(2) with respect to the sale of non-certified small off-road engines. This settlement takes into consideration that Swisher self-reported violations, was proactive and cooperative throughout the enforcement process, and does not have a history of violations.
