Sud-Chemie, Inc. Case Settles for $51,792
In September 2011, Sud-Chemie Inc. agreed to pay $51,792.00 in penalties for violating air quality regulations: $38,844.00 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $12,948.00 will go to Peralta Community College District to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in September 28, 2011. An investigation by the Air Resources Board (ARB) showed that Sud-Chemie Inc. failed to comply with the Verification Procedure, with respect to offering for sale and selling in California, between 2008 and 2009, EnviCat Diesel Particulate filters used in stationary emergency standby engines applications that did not conform to the conditions specified in the Verification Procedure and the filter’s applicable executive orders. To settle the case, Sud-Chemie Inc. agreed to the $51,792.00 penalty and to comply with the Verification Procedure.
