Southern Counties Oil Company Case Settles for $10,950
Southern Counties Oil Company will pay $10,950.00 in penalties for violating air quality regulations: $8,214.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,736.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in September 28, 2016.
In September 2015, Enforcement Division initiated an investigation on Southern Counties Oil Company from an anonymous complaint. The investigation revealed that Southern Counties Oil Company: (1) failed to properly self-inspect its diesel trucks, as required by the Periodic Smoke Inspection Program (PSIP) as codified in California Code of Regulations, title 13, section 2190 et seq. (13 CCR § 2190 et.seq.); (2) failed to verify compliance for each vehicle hired or dispatched and to maintain records as required by the Truck and Bus Regulation; and (3) failed to include the Disclosure of Regulation Applicability on the bills of sale, contract addendums, or invoices, in violation of 13 CCR § 2025(w). ARB documented violations as they related to the Truck and Bus Regulation and the PSIP program. To settle the case, Southern Counties Oil Company has agreed to the $10,950.00 penalty and to comply with the Truck and Bus and PSIP regulation and other ARB applicable regulations.
