Sierra Pacific Industries, Inc. Settles for $40,000
Sierra Pacific Industries, Inc. submitted timely greenhouse gas emissions data reports covering the year 2011 for numerous biomass facilities. Although biomass energy generation is not covered by the Cap-and-Trade Regulation, emissions must still be reported and verified. Because Sierra Pacific Industries operated its Sonora biomass facility for only a short time in 2011, that facility was overlooked, resulting in a late emissions report for that facility, in violation of the Regulation for the Mandatory Reporting of Greenhouse Gas Emissions, California Code of Regulations, title 17, section 95100 et seq. Sierra Pacific Industries cooperated with ARB’s investigation. To resolve the matter Sierra Pacific Industries submitted and verified its Sonora report, agreed to conduct a compliance audit of all of its facilities, agreed to submit an updated Greenhouse Gas Monitoring Plan, and to pay a penalty of $40,000.
