Samson, Inc. Case Settles for $33,500.00
Samson, Inc., a manufacturer of aftermarket performance exhaust systems for highway motorcycles, entered into a mutual settlement with the Air Resources Board (ARB) in December 2013. The South Dakota-based company was discovered to have sold several exhaust systems in California between January 2009 and August 2013 that did not receive the required exemptions from the state’s anti-tampering laws. Samson, Inc. fully cooperated with ARB during its subsequent investigation.
The resulting civil penalty of $33,500.00 was applied to 134 part violations at a rate of $250.00 per unit. As part of the settlement agreement, Samson, Inc. will implement a compliance plan that will include the buyback of its non-exempted parts that were not exclusively purchased for competition purposes.
