A & S Metal Recycling Inc. Case Settles for $99,450
In July 2015, A & S Metal Recycling Inc. (A & S), based in Los Angeles, agreed to pay $99,450.00 in penalties for violating air quality regulations: $74,588.00 will go to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; and $24,862.00 will go to the School Bus Retrofit Project to retrofit school buses throughout California with diesel emission control strategies.
An investigation by the Air Resources Board (ARB) showed that A & S failed to comply with the Truck and Bus (TB) rule by neglecting to install legally required emission reduction devices by applicable compliance dates pursuant to 13 CCR section 2025(g). Further, A & S failed to properly self-inspect their diesel trucks to assure the trucks met Periodic Smoke Inspection Program (PSIP) emission standards as codified in 13 California Code of Regulation (CCR) section 2190 et seq.; and the Emission Control Label (ECL) Regulation as codified in Health and Safety Code section 44011.6 and 13 CCR section 2183, et seq.
To settle the case, A & S agreed to the $99,450.00 penalty and to comply with the TB, PSIP, and ECL programs in addition to other ARB programs.
