RM Produce Corporation Case Settles for $2,100
In October 2014, RM Produce Corporation paid $2,100.00 in penalties for violating air quality regulations: $1,575.00 went to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $525.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program.
An investigation by the Air Resources Board (ARB) showed that RM Produce Corporation failed to bring one of its Transport Refrigeration Units (TRU) in compliance with the in-use performance standards; failed to delegate the third party reporting consultant for the TRU fleet; failed to update the TRU operator report within 30 days of changes to the fleet; and failed to disclose the regulation applicability on the bill of sale for one truck subject to Statewide Truck and Bus (STB) rule. ARB documented violations as they related to the TRU Air Toxic Control Measure regulation and STB rule. To settle the case, RM Produce Production agreed to the $2,100.00 penalty and to comply with the TRU, STB and other ARB programs.
