CARB requested that the US EPA Region 9 administrator use his discretion to evaluate the effectiveness of California’s ERC programs according to the Federal Emissions Trading Policy (1986).
The memo is regarding the use of emission credits from the permanent shutdown of stationary sources. Page 7 contains the policy prescription that ERCs should be surplus at time of use to avoid double counting of reductions in its attainment plan.

The agreement describes the procedures for maintaining and updating an emission tracking system for “demonstrating the adequacy” of SJV’s Rule 2201 (NSR). This agreement is the foundation for Section 7.0 of Rule 2201.
