NewStar Fresh Foods, LLC Case Settles for $10,000
NewStar Fresh Foods, LLC paid $10,000.00 in penalties for violating air quality regulations: $7,500.00 went to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,500.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in June 2016.
An investigation by the Air Resources Board (ARB) showed that NewStar Fresh Foods, LLC failed to verify that each hired or dispatched vehicle is in compliance with the Truck and Bus (TB) Regulation and one hired fleet was ultimately determined out of compliance with the TB regulation. In addition, NewStar had failed to require the carriers it hired or contracted with for transport of perishable goods to only dispatch compliant Transport Refrigeration Units (TRU) when they traveled on California highways. ARB documented violations as they related to the TRU Airborne Toxic Control Measure and the TB Regulation. To settle the case, NewStar Fresh Foods, LLC agreed to the $10,000.00 penalty and to comply with TRU, TB, and other ARB programs.
