Navistar, Inc. Settles for $2,026,800.00
In December 2019, Navistar, Inc. (Navistar), located in Lisle, Illinois, settled a case with the California Air Resources Board (CARB) for violations of Health and Safety Code section 43106. CARB testing revealed that Navistar performed some undocumented running changes and/or field fixes on its engines, such that they would not set On‑Board Diagnostic Readiness for the Selective Catalytic Reduction System, and thus were not substantially the same as their certified configuration (Subject Units). The affected Navistar engine families were DNVXH07570SB, ENVXH05700SA, ENVXH07570SB, FNVXH05700SA, and FNVXH07570SB. The per unit penalties for Navistar in this case are $2,500.00 per unit for 799 new production Subject Units with the undocumented running change, and $50.00 per unit for 586 post-production field-fixed Subject Units with the undocumented running change, resulting in a total penalty amount of $2,026,800.00. Navistar opted to pay half of the total penalty amount to a Supplemental Environmental Project. Navistar is now in compliance with the California regulations.
