Mr. Muffler, Inc. Case Settles for $9,000
Mr. Muffler, Inc. paid $9,000.00 in penalties for violating air quality regulations: $6,750.00 went to the California Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $2,250.00 went to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology (CCDET) program. This settlement was reached in September 2014.
An investigation by the Air Resources Board (ARB) showed that Mr. Muffler, Inc. offered to sell and installed diesel particulate filters in a non-verified configuration. Mr. Muffler, Inc. was also not an authorized installer of verified diesel emission control strategy. ARB documented violations as they related to the Verification Procedure, the Aftermarket Parts Regulations and of the California Vehicle Code section 27156. To settle the case, Mr. Muffler, Inc. agreed to the $9,000.00 penalty and to comply with the Verification Procedure, the Aftermarket Parts Regulations and the California Vehicle Code section 27156. In addition, Mr. Muffler, Inc. also agreed to a recall campaign of all unauthorized installations.
