Midwest Can Company, LLC Settles For $576,511.80
In December of 2019, Midwest Can Company, LLC (Midwest), headquartered in Franklin Park, Illinois, settled its case with the California Air Resources Board (CARB). CARB conducted compliance testing in 2017 on portable fuel containers (PFC) manufactured by Midwest. The PFCs failed to meet CARB’s diurnal performance standard of 0.3 g/gal/day, making them in violation of California Code of Regulations, title 13, section 2467 et seq.
Midwest cooperated with CARB during the agency’s investigation. The resulting settlement requires the company to pay a $3.70 per unit penalty resulting in a total penalty of $576,511.80. As part of the settlement, Midwest has agreed to provide $288,255.90 of the total penalty as a Supplemental Environmental Project to Fresno TREES.
Midwest agrees that any PFC sold, supplied, offered for sale, advertised, or manufactured for sale in California, will comply with all applicable standards.
