Maggiora Bros. Drilling, Inc. Settles For $49,500
In January 2023, the California Air Resources Board (CARB) reached a settlement with Maggiora Bros. Drilling, Inc. (Maggiora), with its principal location in Watsonville, California. If Maggiora is unable to satisfactorily comply with the terms set forth by CARB in the Settlement Agreement, Maggiora will pay $49,500 in penalties for violating air quality regulations.
An investigation conducted by CARB staff showed that Maggiora violated the Off-Road (OR) Regulation by failing to comply with the in-use compliance requirements by the compliance date (Cal. Code Regs., tit. 13, § 2449(d)); violated the Truck and Bus (TB) Regulation by failing to comply with the reporting requirements (Cal. Code Regs., tit. 13, § 2025(r)), compliance schedule (Cal. Code Regs., tit. 13, § 2025(e), (f), (g), (h), (k), (l), (m), (n), and (o)); BACT requirements (Cal. Code Regs., tit. 13,
§ 2025(s)); and violated the Periodic Smoke Inspection Program (PSIP) by failing to meet the applicable smoke-testing requirements for multiple heavy-duty diesel vehicles in their fleet (Cal. Code Regs., tit. 13, § 2190 et seq.). CARB documented the violations as they related to the OR Regulation, TB Regulation, and PSIP. To settle the case, Maggiora agreed to the suspended penalty total of $49,500.
To settle the case, Maggiora must implement and submit to CARB a Compliance Plan within 45 days of the settlement date to ensure that Maggiora complies with the OR Regulation and TB Regulation. Maggiora agreed to submit periodic smoke opacity tests for 2022 and 2023 by January 31 of the following year, and to comply with all other CARB regulations going forward.
If Maggiora is unable to comply with the terms set forth in the Settlement Agreement, Maggiora will pay $49,500 to CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California’s Air Quality. Maggiora fully cooperated with CARB to resolve this matter.
