Kouklis Equipment Company Case Settles for $29,250
An investigation by the California Air Resources Board (CARB) showed that Kouklis Equipment Company (KEC) was in violation of the Truck and Bus Regulation as codified in California Code of Regulations (CCR), title 13, section 2025 (13 CCR § 2025) and the Transport Refrigeration Unit Airborne Toxic Control Measure (TRU ATCM) (13 CCR § 2477). The violations were first discovered from a list identifying top noncompliant fleets found in the Air Resources Board Equipment Registration (ARBER) database. KEC failed to meet the Engine Model Year Compliance Schedule set forth in the Truck and Bus Regulation for three of their vehicles and failed to meet in-use performance standards before the deadlines set forth in the TRU ATCM for 11 of their TRUs.
The total penalty assessed in this case was $29,250. The total penalty obtained for the Truck and Bus violations in this case is $21,000, or $7,000 per vehicle. The total penalty assessed for TRU ATCM violations involved in this case is $8,250, or $750 per violation. The investigation identified emissions violations, however the penalty was discounted based on the fact that it was a first time violation and KEC made diligent efforts to comply and to cooperate with the investigation.
KEC agreed to the conditions of the settlement including the total penalty payment going to the Air Pollution Control Fund which provides funding for projects and research to improve California's air quality, submission of proof of compliance with the Truck and Bus Regulation within 30 days of the execution of Settlement Agreement, and submission of proof of compliance with the TRU ATCM within 45 days of the execution of Settlement Agreement. KEC is working on bringing all vehicles in to compliance with the Truck and Bus Regulation and the TRU ATCM within the time frame specified in the Settlement Agreement.
