Imperial Valley Commercial Properties LLC and Oakview Constructors, Inc. Case Settles for $14,000
In April 2016, Imperial Valley Commercial Properties LLC, and Oakview Constructors, Inc., paid $14,000.00 in penalties for violating air quality regulations. State Law establishes the Asbestos National Emissions Standard for Hazardous Air Pollutants as Airborne Toxic Control Measure (Asbestos ATCM) enforceable by Air Resources Board (ARB). The Asbestos ATCM requires the owner(s) or operator(s) of demolition or renovation activities to thoroughly inspect for the presence of asbestos, and to provide written notification of the intention to demolish or renovate a regulated facility ten (10) working days before demolition or renovation begins.
An inspection by ARB staff showed that Imperial Valley Commercial Properties LLC, and Oakview Constructors, Inc., failed to thoroughly inspect for the presence of asbestos and failed to properly notify ARB before demolishing a commercial structure in Imperial County. To settle the case, Imperial Valley Commercial Properties LLC, and Oakview Constructors, Inc. agreed to the $14,000.00 penalty.
