Hypertech, Inc. Case Settles for $225,000
In 2013, the Air Resources Board (ARB) determined that performance parts manufacturer Hypertech, Inc., was advertising, offering for sale, and/or selling emission-related add-on and modified parts, primarily for diesel trucks, that were not exempted from California’s anti-tampering laws. The subject aftermarket parts replaced original emission components, such as the fuel pump, or implemented different fuel calibrations. However, these parts had not been evaluated by ARB in order to demonstrate continued diesel emissions compliance prior to being be sold and installed on California vehicles.
Hypertech, Inc. fully cooperated with ARB and provided all needed information during the agency’s investigation of the matter. ARB consequently settled the case in June 2016 for $225,000. This civil penalty is applicable to 600 illegal performance parts sold in the state between 2011 and 2013, at a rate of $375 per unit. The company has also agreed to institute a voluntary buyback program to retrieve these parts from its customers at no cost to them.
