H&S Performance, LLC Case Settles for $1,000,000
On August 6, 2014, H&S Performance, LLC (H&S) settled its case with the Air Resources Board (ARB) and the California Attorney General's Office involving sales of the company's diesel performance parts in violation of California's anti-tampering laws. ARB had determined that a number of such parts were illegally sold in the state during the past several years, including truck tuners and other exhaust products. H&S cooperated with ARB during its investigation and, in addition to a civil fine, agreed to initiate a recall program covering all of the illegally sold parts.
The total civil penalty amount of $1,000,000 will be paid by H&S to two funds, with $750,000 to California’s Air Pollution Control Fund and the remaining $250,000 to the School Bus and Diesel Emission Reduction Supplemental Environmental Project, which is implemented by the San Joaquin Valley Air Pollution Control District.
