$90,000 in Fines Paid by Harley Davidson
On a routine inspection in March, 2007 of Harley Davidson dealers located in California, it was found that some dealers were selling motorcycles built by Thunder Mountain Motorcycle Company that had not been certified by ARB. The Thunder Mountain motorcycles found in violation were built by a manufacturer located in Colorado that had only certified one model of their line of motorcycles for sale in California for model year 2006 and 2007. The motorcycles found in violation used a Harley Davidson engine and transmission. A Notice of Violation was issued to San Diego Harley Davidson with penalties of $35,000.00 for violations of H&SC 43150-43153. A Notice of Violation was also issued to Bartels' Harley Davidson located in Marina Del Rey with penalties of $35,000.00 for violations of H&SC 43150-43153. A Notice of Violation was also issued to Harley Davidson of Sacramento with penalties of $20,000.00 for violations of H&SC 43150-43153. To settle their case in June 2007, the manufacture paid the penalties for all of the dealers and removed the illegal non-California-certified motorcycles that were left in the dealers' stock from California. Thunder Mountain has now certified all of its models for 2007 with ARB. We are in settlement negotiations with the manufacture.
