Gorditos Transportation, Inc. Case Settles for $15,300
Gorditos Transportation Inc. will pay $15,300.00 in penalties for violating air quality regulations: $11,475.00 will go to the Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality; $3,825.00 will go to the Peralta Colleges Foundation to fund emission education classes conducted by participating California community colleges, under the California Council for Diesel Education and Technology program. This settlement was reached in June 2016.
An investigation by the Air Resources Board (ARB) showed that Gorditos Transportation Inc. failed to: (1) properly self-inspect its diesel trucks as required by Periodic Smoke Inspection Program (PSIP), (2) properly affix Emission Control Label (ECL) on an engine in their vehicle fleet, (3) bring Transport Refrigeration Unit (TRU) into compliance with the in-use performance standards, (4) indicate the third party consultant that filled out the application when applying for ARB Identification Numbers for its California-based TRUs, and (5) meet particulate matter best available control technology requirements for their Truck and Bus (TB) fleet. ARB documented violations as they related to the PSIP, ECL requirements, TRU Airborne Toxic Control Measure, and the TB Regulation. To settle the case, Gorditos Transportation Inc. agreed to the $15,300.00 penalty and to comply with PSIP, TRU, TB, ECL requirements and other ARB programs.
