Goldenvale Inc. Criminal Case
A five year investigation into illegal activities on the part Goldenvale Inc., Kenning Ma, President and Owner and his wife Shirley Ji, Vice President, came to a successful completion on April 28, 2010.
An ARB investigation resulted in this case being referred to the San Bernardino County Office of the District Attorney. The DA charged Goldenvale and its officers, in a 70 count criminal complaint, with felony counts including conspiracy, grand theft, possession of false documents and money laundering. These counts were charged because Goldenvale and its officers imported, offered for sale and sold uncertified off-highway recreational vehicles and on-road vehicles in California without ARB certification as required by California law.
Ma and Ji were arrested on March 11, 2010 and held in county jail on $150 million and $75 million bail, respectively. On April 28, 2010, Kenning Ma plead no contest to four felony counts of grand theft and was ordered to provide restitution to all victims in the case. Vice President Shirley Ji, plead guilty to one felony count of conspiracy to commit grand theft and one felony count of grand theft. A restitution hearing has been set for June 29, 2010 and a probationary hearing for July 20, 2010.
Deputy District Attorney Doug Poston said, "The felony pleas, sentencing and the amount of time in custody are very significant for a case which had its beginnings in an investigation over air quality issues." Goldenvale is one of the largest importers of foreign on and off-road motorcycles and recreational vehicles in the U.S. located in Ontario, California. A civil action is still pending against Goldenvale and its principals.
