George L. Throop, Co., Settles Portable Equipment Violation for $46,400
In November 2021, the California Air Resources Board (CARB) reached a settlement with George L. Throop, Co., of principal location in Pasadena, California, in the amount of $46,400 for violating CARB’s air quality regulations. Of the total penalty amount, $23,200 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California’s air quality. The remaining amount of $23,200 will fund a Supplemental Environmental Project entitled the Fresno TREES Project. Fresno TREES plants trees and shrubs along major roads in and around Fresno to help mitigate air pollution from affecting the local population.
CARB staff initiated an investigation into George L. Throop, Co., after becoming aware of an altered Statewide Portable Equipment Registration (PERP) Document, which is a violation of Health & Saf. Code § 42402. CARB and South Coast Air Quality Management District (SCAQMD) staff conducted a joint inspection at George L. Throop, Co.’s Pasadena location and found the cement silo with the false PERP Registration Document. In addition, the operations records of the silo were not provided when they were requested by the joint inspection team. George L. Throop, Co. later cooperated with the investigation and provided the requested records as required by Health & Saf. Code § 41754. To settle the case, George L. Throop, Co. agreed to the total penalty of $46,400.
Terms of the settlement include a requirement for George L. Throop, Co. to comply with all CARB regulations going forward. As a preventative effort, George L. Throop, Co. registered all portable equipment into the PERP program including the equipment found with the false registration.
